Terms and Conditions
Article 1 (Purpose)
These Terms and Conditions of Use (the "T&C") are intended to set forth the rights, duties, and responsibilities of users of the internet-related services (hereinafter referred to as the "Service") provided by the online shopping mall (hereinafter referred to as the "Mall") operated by KRC Group Co., Ltd. (e-commerce company).
※ These T&C also apply to e-commerce transactions using PC communication, wireless, and other means unless they contradict the nature of the transactions.
Article 2 (Definitions)
① "Mall" refers to the virtual business site established by KRC Group Co., Ltd. to provide goods or services (hereinafter referred to as "Goods and Services") to users by utilizing computers and information communication facilities, and it is also used to mean the business operator that runs the cybermall.
② "User" refers to both Members and Non-Members who access the "Mall" and receive the services provided by the "Mall" in accordance with these T&C.
③ "Member" refers to a user who has registered as a member of the "Mall" and can continuously use the services provided by the "Mall."
④ "Non-Member" refers to a user who uses the services provided by the "Mall" without registering as a member.
Article 3 (Display, Explanation, and Amendment of Terms and Conditions)
① The "Mall" shall display the contents of these T&C, the company name and representative's name, the business address (including the address for handling customer complaints), phone number, email address, business registration number, e-commerce permit number, and the name of the person responsible for managing personal information on the main page of daehanhanbok.online for easy recognition by users. However, the content of the T&C can be displayed through a link page.
② The "Mall" must provide a separate link or pop-up screen to ensure that users understand important details such as cancellation rights, delivery responsibilities, and refund conditions before they agree to these T&C.
③ The "Mall" may amend these T&C without violating applicable laws such as the 「Act on Consumer Protection in Electronic Commerce」, 「Regulation of Terms and Conditions」, 「Framework Act on Electronic Documents and Transactions」, 「Electronic Financial Transaction Act」, 「Electronic Signature Act」, 「Act on Promotion of Information and Communications Network Utilization and Information Protection」, 「Door-to-Door Sales Act」, and 「Framework Act on Consumers」.
④ When the "Mall" amends the T&C, it shall specify the effective date and the reasons for the amendment and post it along with the current T&C on the initial screen of the Mall from 7 days before the effective date until the day before the effective date. If the amendment is disadvantageous to the user, the "Mall" shall provide at least 30 days' notice. In this case, the "Mall" shall clearly compare the changes before and after in an easy-to-understand manner.
⑤ When the "Mall" amends the T&C, the amended T&C shall apply only to contracts concluded after the effective date, while contracts concluded before the effective date shall remain under the provisions of the old T&C. However, if a user who has already signed a contract wishes to apply the amended T&C, they may send their intent to the "Mall" during the notice period specified in Clause ④ and obtain consent from the "Mall."
⑥ Any matters not specified and interpreted in these T&C shall be governed by the 「Act on Consumer Protection in Electronic Commerce」, the 「Regulation of Terms and Conditions」, and the e-commerce consumer protection guidelines established by the Fair Trade Commission and other applicable consumer protection laws and regulations.
Article 4 (Provision and Change of Services)
① The "Mall" performs the following tasks:
1. Providing information on Goods and Services and concluding purchase contracts.
2. Delivering Goods and Services for which purchase contracts have been concluded.
3. Other tasks defined by the "Mall."
② If Goods and Services are out of stock or technical specifications change, the "Mall" may change the content of Goods and Services to be provided under future contracts. In such cases, the "Mall" shall immediately announce the changes and the content of the current Goods and Services where they were posted.
③ If the "Mall" changes the content of services for which it has concluded contracts with users due to reasons such as the out-of-stock status of Goods and Services or changes in technical specifications, the "Mall" shall immediately notify users at the address they can be contacted.
④ In the case of the preceding clause, the "Mall" shall compensate users for any damages incurred. However, this does not apply if the "Mall" proves that there is no intention or negligence.
Article 5 (Service Interruption)
① The "Mall" may temporarily suspend the provision of services in the event of maintenance, replacement, or breakdown of computers or information communication facilities, or communication interruptions.
② The "Mall" shall compensate users or third parties for damages caused by the temporary suspension of service due to reasons stated in Clause ①. However, this does not apply if the "Mall" proves that there was no intention or negligence.
③ If the "Mall" is unable to provide services due to reasons such as changes in business categories, abandonment of business, or mergers between companies, the "Mall" shall notify users in the manner prescribed in Article 8 and compensate consumers according to the conditions initially presented by the "Mall." If the "Mall" does not announce the compensation criteria, the "Mall" shall pay users mileage or reserve funds in cash or equivalents corresponding to the value of the currency used in the "Mall."
Article 6 (Membership Registration)
① Users may apply for membership by completing the membership information form set by the "Mall" and indicating their agreement to these T&C.
② The "Mall" shall register as members those users who apply for membership as described in Clause ①, except for those falling under any of the following:
1. If the applicant has previously lost membership status under Clause 3 of Article 7. However, an exception is made if more than 3 years have passed since the loss of membership status under Clause 3 of Article 7, and the "Mall" has granted re-acceptance of membership.
2. If there are false, missing, or erroneous entries in the registration information.
3. If it is deemed that registering the user as a member would cause significant technical difficulties for the "Mall."
③ The membership registration contract is established at the time when the "Mall"'s acceptance reaches the member.
④ Members must notify the "Mall" of any changes to the information registered at the time of membership registration within a reasonable period using methods such as modifying their member information.
Article 7 (Withdrawal of Membership and Loss of Eligibility)
① Members may request to withdraw from the "Mall" at any time, and the "Mall" shall immediately process the membership withdrawal.
② If a member falls under any of the following circumstances, the "Mall" may restrict or suspend their membership:
1. If false information was registered during the membership application.
2. If the member fails to pay for goods purchased using the "Mall" or other debts owed to the "Mall" by the due date.
3. If the member obstructs the use of the "Mall" by others or steals information, thereby threatening the order of electronic commerce.
4. If the member uses the "Mall" to engage in acts prohibited by law or these T&C, or acts contrary to public order and morals.
③ If the "Mall" restricts or suspends membership and the same act is repeated twice or more, or if the cause is not rectified within 30 days, the "Mall" may terminate the member's eligibility.
④ If the "Mall" terminates a member's eligibility, it shall deregister the member. In such cases, the "Mall" shall notify the member and provide a period of at least 30 days for the member to explain before deregistration.
Article 8 (Notifications to Members)
① When the "Mall" needs to notify members, it can do so via the email address designated in advance by the member in agreement with the "Mall."
② For notifications to an unspecified number of members, the "Mall" may substitute individual notifications by posting on the "Mall" bulletin board for at least one week. However, for matters that have a significant impact on the member's transactions, individual notifications will be made.
Article 9 (Purchase Application and Consent to Provide Personal Information, etc.)
① Users of the "Mall" apply for purchases by following a method similar to the following, and the "Mall" shall provide the following information in an easy-to-understand manner when the user makes a purchase application:
1. Search and select goods, etc.
2. Enter the recipient’s name, address, phone number, email address (or mobile phone number), etc.
3. Confirm details related to costs such as terms and conditions, services with restricted withdrawal rights, shipping fees, installation fees, etc.
4. Agree to these terms and conditions and indicate confirmation or rejection of the details mentioned in 3. (e.g., by clicking a mouse)
5. Apply for the purchase of goods, etc. and agree to or confirm the "Mall"’s confirmation of the application.
6. Select a payment method.
② If the "Mall" needs to provide the purchaser’s personal information to a third party, it must inform the purchaser and obtain consent for the following:
the recipient of the personal information, 2) the purpose of use of the personal information by the recipient, 3) the items of personal information provided, and 4) the period for which the recipient will retain and use the personal information. The same applies if there are changes to the agreed terms.
③ If the "Mall" entrusts a third party with the handling of the purchaser’s personal information, it must inform the purchaser and obtain consent for the following:
the recipient of the personal information handling delegation, and 2) the details of the work delegated for personal information handling. The same applies if there are changes to the agreed terms. However, if it is necessary for the performance of the service contract and is related to the purchaser’s convenience, the "Mall" can notify through the privacy policy in accordance with the methods stipulated by the 「Act on Promotion of Information and Communications Network Utilization and Information Protection」 without following the notification and consent procedures.
Article 10 (Establishment of Contract)
① The "Mall" may not accept a purchase application as described in Article 9 if it falls under any of the following. However, if a contract is concluded with a minor, the "Mall" must notify that the contract can be canceled by the minor or their legal representative if the minor does not obtain the consent of the legal representative:
1. If there are false, missing, or erroneous entries in the application.
2. If a minor purchases goods and services such as tobacco or alcohol prohibited by the Youth Protection Act.
3. If the acceptance of the purchase application is deemed to cause significant technical difficulties for the "Mall."
② The contract is considered established when the "Mall"’s acceptance reaches the user in the form of an acknowledgment of receipt as per Clause 1 of Article 12.
③ The “Mall”'s expression of acceptance shall include confirmation of the user’s purchase application, information on the availability of sales, and details on the correction or cancellation of the purchase application.
Article 11 (Payment Method)
The payment methods for goods or services purchased from the “Mall” can be made using any of the following available methods. The “Mall” shall not impose any additional fees on the payment of goods, etc., regardless of the payment method chosen by the user:
1. Various account transfers such as phone banking, internet banking, and mail banking.
2. Payment by various cards such as prepaid cards, debit cards, and credit cards.
3. Online bank transfers.
4. Payment by electronic currency.
5. Payment upon receipt.
6. Payment by points such as mileage provided by the “Mall.”
7. Payment by gift certificates recognized by the “Mall” or contracted with the “Mall.”
8. Payment by other electronic payment methods.
Article 12 (Notification of Receipt, Modification, and Cancellation of Purchase Application)
① When the “Mall” receives a purchase application from a user, it shall send a confirmation of receipt to the user.
② Upon receiving the confirmation of receipt, the user may request immediate modification or cancellation of the purchase application if there is any discrepancy in their intention. The “Mall” shall process the user's request without delay if the request is made before the shipment. However, if payment has already been made, it shall follow the regulations on withdrawal of subscription under Article 15.
Article 13 (Supply of Goods, etc.)
① Unless there is a separate agreement with the user regarding the timing of the supply of goods, the “Mall” shall take necessary measures, such as order production and packaging, to deliver the goods within 7 days from the date of the user’s subscription. However, if the “Mall” has already received all or part of the payment, it shall take action within 3 business days from the date of receipt of all or part of the payment. At this time, the “Mall” shall take appropriate measures to allow the user to check the supply procedure and progress of the goods.
② The “Mall” shall specify the delivery method, the party responsible for the delivery costs, and the delivery period for the purchased goods. If the “Mall” exceeds the agreed delivery period, it shall compensate the user for any damages incurred. However, this shall not apply if the “Mall” proves that there was no intentional act or negligence.
Article 14 (Refunds)
If the “Mall” cannot deliver or provide the goods, etc., requested by the user due to reasons such as being out of stock, it shall promptly notify the user of the reason. If the “Mall” has already received payment for the goods, it shall refund the payment within 3 business days or take necessary measures for the refund.
Article 15 (Withdrawal of Subscription, etc.)
① Users who have entered into a contract with the “Mall” for the purchase of goods, etc., may withdraw their subscription within 7 days from the date they receive a written document regarding the contract details as per Article 13(2) of the Act on Consumer Protection in Electronic Commerce, etc. (If the supply of goods, etc. is later than the receipt of the written document, the withdrawal period starts from the date the goods, etc. are supplied or the supply starts). However, if otherwise stipulated by the Act on Consumer Protection in Electronic Commerce, etc., those provisions shall apply.
② Users who have received goods, etc., may not return or exchange them in the following cases:
1. If the goods, etc., are lost or damaged due to reasons attributable to the user (except if the packaging is damaged to check the contents of the goods, etc.).
2. If the value of the goods, etc., has significantly decreased due to the user's use or partial consumption.
3. If the value of the goods, etc., has significantly decreased to the extent that resale is difficult due to the passage of time.
4. If the packaging of the original goods, etc., is damaged in the case where the goods, etc., can be duplicated with the same performance.
③ In the cases of Clauses 2.2 to 2.4, if the “Mall” has not clearly indicated in a place easily accessible to consumers that the withdrawal of subscription is restricted, or if the “Mall” has not provided a trial product, the user’s withdrawal of subscription shall not be restricted.
④ Notwithstanding Clauses 1 and 2, if the content of the goods, etc., is different from the indication or advertisement, or if the contract is performed differently, the user may withdraw their subscription within 3 months from the date they received the goods, etc., or within 30 days from the date they knew or could have known the fact.
Article 16 (Effects of Withdrawal of Subscription, etc.)
① When the “Mall” receives the return of goods, etc., from the user, it shall refund the payment for the goods, etc., within 3 business days. In this case, if the “Mall” delays the refund to the user, it shall pay delay interest calculated by multiplying the delay period by the delay interest rate prescribed in Article 21-2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc.
② In refunding the above payment, if the user paid for the goods, etc., by credit card or electronic money, the “Mall” shall promptly request the business operator who provided the payment method to suspend or cancel the payment for the goods, etc.
③ In the case of withdrawal of subscription, the user shall bear the cost of returning the supplied goods, etc. The “Mall” shall not claim any penalty or damages for the withdrawal of subscription. However, if the content of the goods, etc., is different from the indication or advertisement, or if the contract is performed differently, the “Mall” shall bear the cost of returning the goods, etc.
④ If the user paid for shipping when receiving the goods, the “Mall” shall clearly indicate who will bear the cost in case of withdrawal of subscription, in a way that is easy for the user to understand.
Article 17 (Protection of Personal Information)
① The "Mall" collects the minimum amount of personal information necessary for providing services when collecting user's personal information.
② The "Mall" does not collect information necessary for performing the purchase contract at the time of membership registration. However, if it is necessary to verify the identity before the purchase contract due to legal obligations, the "Mall" does not collect a minimum amount of specific personal information.
③ When collecting and using user's personal information, the "Mall" notifies the user of the purpose and obtains consent from the user.
④ The "Mall" may not use collected personal information for purposes other than the intended purpose. In cases where a new purpose arises or the information is provided to a third party, the "Mall" notifies the user of the purpose and obtains consent at the time of use or provision. However, this is excepted if otherwise provided by relevant laws.
⑤ When the user's consent is required as per Clauses 2 and 3, the "Mall" must specify or notify in advance the matters prescribed in Article 22(2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., such as the identity of the personal information manager (affiliation, name, telephone number, and other contact information), the purpose of collecting and using information, and the matters related to providing information to third parties. The user may withdraw this consent at any time.
⑥ Users may request to view and correct their personal information held by the "Mall," and the "Mall" shall promptly take necessary measures. If the user requests correction of errors, the "Mall" shall not use the personal information until the errors are corrected.
⑦ The "Mall" must minimize the handling of user's personal information to protect personal information. The "Mall" shall be liable for any damages incurred by users due to the loss, theft, leakage, provision to third parties without consent, alteration, etc., of user's personal information, including credit card and bank account information.
⑧ The "Mall" or the third party that received personal information from the "Mall" must promptly destroy the personal information when the purpose of collecting or receiving the information is achieved.
⑨ The "Mall" does not pre-select the consent box for the collection, use, or provision of personal information. Also, the "Mall" clearly specifies the services restricted if the user refuses consent for the collection, use, or provision of personal information that is not essential. The "Mall" does not restrict or refuse membership registration or service provision based on the user's refusal of consent for the collection, use, or provision of non-essential personal information.
Article 18 (Provision of Information and Posting of Advertisements)
① The "Mall" may provide various marketing information deemed necessary during service use to members via electronic mail, written mail, SMS, telephone, push notifications, and SNS services linked to member contacts, and members agree to this. In this case, depending on the member's communication environment or tariff structure, the member may incur data charges, etc.
② Except for transaction-related information under relevant laws and answers to customer inquiries, members may refuse to receive electronic mail, etc., as described in the preceding paragraph at any time. In this case, the "Mall" immediately discontinues the provision of marketing information, etc., as described in the preceding paragraph.
Article 19 (Obligations of the "Mall")
① The "Mall" shall not engage in acts prohibited by laws or contrary to public order and morals, and shall make every effort to continuously and stably provide goods or services in accordance with this Agreement.
② The "Mall" shall establish a security system to protect the personal information of users (including credit information) so that users can safely use Internet services.
③ If the "Mall" causes damage to users by engaging in unfair display or advertising practices as specified in Article 3 of the Act on Fair Display and Advertising of Goods and Services regarding goods or services, it shall be liable for compensation.
④ The "Mall" shall not send commercial electronic mails for profit-making purposes that users do not want.
Article 20 (Member's Obligations regarding ID and Password)
① Except as provided in Article 17, the responsibility for managing the ID and password lies with the member.
② Members must not allow third parties to use their IDs and passwords.
③ If a member becomes aware that their ID and password have been stolen or are being used by a third party, they must immediately notify the "Mall" and comply with the instructions provided by the "Mall" if any.
Article 21 (Obligations of Users)
Users must not engage in the following actions:
1. Registering false information when applying for or modifying information.
2. Impersonating others' information.
3. Modifying information posted on the "Mall."
4. Transmitting or posting information (such as computer programs) other than the information specified by the "Mall."
5. Infringing on the copyrights or other intellectual property rights of the "Mall" or third parties.
6. Damaging the honor of the "Mall" or third parties or interfering with business activities.
7. Disclosing or posting obscene or violent messages, images, audio, or other information that violates public order and morals on the "Mall."
Article 22 (Relationship between Linked "Mall" and Linking "Mall")
① When a superior "Mall" and a subordinate "Mall" are connected through methods such as hyperlinks (e.g., hyperlinks may include text, images, and illustrations), the former is referred to as the linking "Mall" (website), and the latter as the linked "Mall" (website).
② If the linking "Mall" explicitly states on its initial screen or in a pop-up screen at the time of linking that it does not guarantee the transactions conducted with the goods or services independently provided by the linked "Mall," then it shall not be responsible for guaranteeing such transactions.
Article 23 (Ownership and Restriction of Use of Copyrights)
① Copyrights and other intellectual property rights for works created by the "Mall" belong to the "Mall."
② Users must not reproduce, transmit, publish, distribute, broadcast, or otherwise commercially use information owned by the "Mall" for profit-making purposes or provide it to third parties without the prior consent of the "Mall."
③ If the "Mall" uses copyrights belonging to users according to agreements, it must notify the respective users.
Article 24 (Dispute Resolution)
① The "Mall" establishes and operates a dispute compensation organization to reflect legitimate opinions or complaints raised by users and to compensate for damages.
② The "Mall" prioritizes handling complaints and opinions submitted by users. However, if prompt handling is difficult, the reasons and processing schedule will be promptly notified to the users.
③ Regarding disputes arising from e-commerce between the "Mall" and users, if there is a user's request for dispute resolution, it may be subject to mediation by a dispute resolution organization commissioned by the Fair Trade Commission or the governor of a city or province.
Article 25 (Jurisdiction and Governing Law)
① Lawsuits regarding e-commerce disputes between the "Mall" and users are subject to the exclusive jurisdiction of the local court having jurisdiction over the user's address at the time of filing the lawsuit. If the user's address is unclear or if they are a foreign resident, the lawsuit shall be filed with the competent court under the Civil Procedure Act.
② Korean law applies to e-commerce lawsuits filed between the "Mall" and users.
Supplementary Provisions (Effective Date)
These terms and conditions shall be effective from May 27, 2024.
